Federal Jury Convicts Wellsville’s Simon Gogolack of Fentanyl Distribution Resulting in Death, Plus Kidnapping and Witness-Tampering Counts

ANALYSIS · September 11, 2026 (USAO-WDNY announcement / Friday jury verdict) Slug: wellsville-fentanyl-distribution-conviction Package note: Storm Wire optional full-ish second pack. USAO Western District of New York jury conviction (not a plea, not a sentence). Live justice.gov page blocked this pass by Akamai; body reconstructed from a Wayback 200 snapshot. Careful on (1) death-result / distribution caption vs homicide, (2) title “witness intimidation” vs body “witness tampering,” (3) 20-year mandatory minimum / max life as unsentenced statutory exposure, not an imposed term, (4) dismissed pretrial kill-conspiracy counts that are not this verdict.

  • Magistrate complaint (prior, terminated): United States v. Simon Gogolack, No. 1:23-mj-01115, filed Aug. 18, 2023, terminated Sept. 13, 2023. Detention-hearing transcript (RECAP): gov.uscourts.nywd.146969.13.0.pdf — 2023 charging summary, not the 2026 verdict. Early five-count frame (narcotics conspiracy July 2–Aug. 8, 2023; drug-involved premises at 296 Scott Avenue, Wellsville; 924(c); felon-in-possession). Conspiracy max 20 years, no mandatory minimum on that 2023 count-one description. Do not treat the 2023 complaint as the trial indictment or as the verdict.
  • Pretrial order (PACERMonitor snippet, Dkt. 1089): trial as to Gogolack then set August 18, 2026; government had dismissed certain counts; court granted MIL barring jury-nullification argument; declined to bar a defense argument that Crystal Quinn committed suicide; government may introduce evidence of a fentanyl-and-Xanax distribution conspiracy; “hitman services” request denied as moot because the government was no longer pursuing it. Full PDF not retrieved (PACERMonitor returned an HTML gate).
  • Related, separate case — do not conflate: Peter Gerace Jr.’s December 2024 WDNY jury conviction (Buffalo News: guilty on all but one count; later 25-year sentence per WIVB). Gogolack was split off after prosecutors dismissed two retaliation/tampering conspiracy-to-kill-Quinn counts in June 2026.

Core Tension

USAO packages a Friday jury conviction as “distribution of fentanyl causing death, kidnapping and witness intimidation” with a lumped “20 years mandatory minimum / maximum of life,” and DiGiacomo frames it as accountability for “violence and devastation” from drug trafficking — while the office is announcing an unsentenced verdict (sentencing calendared Feb. 9, 2027), the 20-to-life line is statutory exposure on “the charges” rather than a term imposed, the title’s “witness intimidation” is “witness tampering” in the body, and prosecutors had already dismissed the conspiracy-to-kill-a-witness counts, so this is a death-result distribution case (statutory theory does not require intent to kill) plus remaining drug, gun, kidnapping, and tampering counts — not a murder-plot conviction.

What the release claims / conviction facts

What was announced (USAO-WDNY, via Wayback)

A federal jury convicted Simon Gogolack a/k/a Greek, 42, of Wellsville, NY, of:

  1. possession with intent to distribute, and distribution of fentanyl, which resulted in a death,
  2. narcotics conspiracy,
  3. maintaining a drug involved premises,
  4. possession of firearms in furtherance of drug trafficking crimes,
  5. being a felon in possession of a firearm and ammunition,
  6. kidnapping, and
  7. witness tampering.

That is a trial verdict, not a plea. The USAO title uses “Federal jury convicts” and “causing death”; the body uses “which resulted in a death” / “resulted in the death of Crystal Quinn.” Dateline Friday, September 11, 2026, Buffalo. Announced by U.S. Attorney Michael DiGiacomo.

The PR does not list count numbers, a count-by-count scorecard, statutes, a not-guilty count, a restitution figure, or an imposed prison term.

What the USAO attributes to “testimony presented by the Government” (still USAO framing)

  • July 2–October 17, 2023: Gogolack “conspired with others to sell fentanyl, cocaine, methamphetamine, marijuana, Xanax, and Adderall.”
  • July 31–August 1, 2023: “Gogolack distributed fentanyl, which resulted in the death of Crystal Quinn.”
  • During the conspiracy he used “a Scott Avenue residence in Wellsville” for drug trafficking and “possessed firearms.”
  • “He was previously convicted of a felony in 2007 and is legally prohibited from possessing firearms.” (Underlying 2007 offense not named.)
  • “Gogolack was also convicted of kidnapping and threatening an individual and threatening a second individual to prevent them from cooperating with investigators.”

Those sentences are the government’s trial narrative as summarized by USAO, plus the office’s statement of what the jury convicted. They are not a read verdict form.

Penalty language in the PR (exposure, not a sentence)

USAO: “The charges carry a mandatory minimum penalty of 20 years in prison, and a maximum of life.”

That clause is attached to “the charges” collectively. It matches the usual death-result exposure on a 21 U.S.C. § 841 distribution count when death results (commonly 20 years mandatory to life under § 841(b)(1)(C)-style penalties). It does not mean every listed offense independently carries a 20-year mandatory minimum. A 924(c) “in furtherance” count, if it is what the jury convicted, typically adds a consecutive mandatory minimum that the PR does not break out. No term has been imposed.

Sentencing status

  • Not sentenced. USAO: “Sentencing is scheduled for February 9, 2027, before Chief U.S. District Judge Elizabeth A. Wolford, who presided over the trial of the case.”
  • Boilerplate slip in the same release: “The sentencing is the result of an investigation by Homeland Security Investigations … and the Federal Bureau of Investigation …” This is a conviction PR; the investigation produced the case, not a sentencing. Treat as template language, not a claim that sentence has been imposed.

Who worked the case (USAO)

  • Announced by U.S. Attorney Michael DiGiacomo, WDNY.
  • Trial prosecutors: AUSAs Nicholas T. Cooper, Casey L. Chalbeck, and Katerina Powers.
  • Investigated by HSI (Acting SAC Anthony Patrone) and FBI (SAC Allen D. Davis, II).
  • Media contact on the PR: Barbara Burns, 716-843-5817.

USAO quote (framing, not a jury special finding)

DiGiacomo: “Today’s verdict ensures that Simon Gogolack is being held accountable for the violence and devastation his drug trafficking brought into our community and reflects the commitment by my office to pursue and prosecute those that engage in such conduct.”

What this verdict is not (needed for precision)

  • Not a sentence. Feb. 9, 2027 is a calendar date.
  • Not a plea.
  • Not a conviction on the dismissed conspiracy-to-kill / retaliation-and-tampering conspiracy counts. WIVB (Daniel Telvock, June 11, 2026): prosecutors told Judge Wolford they lacked sufficient evidence on those two conspiracy charges as to Gerace and Gogolack; the court accepted the dismissals; remaining Gogolack counts included distribution of fentanyl resulting in death; trials were split; Gogolack trial then set Aug. 18, 2026, in Buffalo.
  • Not a homicide / murder caption. Title “causing death” tracks the USAO headline. Body and trial openings describe a distribution resulting in death theory. Buffalo News / Yahoo trial-open coverage: AUSA Cooper told jurors the government does not have to prove Gogolack intended to kill Quinn or even that he handed her the drugs — “Just that he had the drugs, she used them, and she died as a result.”
  • Not Gerace’s 2024 strip-club trafficking verdict. Keep that case adjacent, not collapsed.

  • Defense / trial-open frame (Yahoo reprint of Buffalo-area coverage): AUSA Cooper’s death-result instruction to the jury (no intent-to-kill requirement; no requirement he handed her the drugs). Defense counsel Nick Texido: government will not prove beyond a reasonable doubt the drugs were Gogolack’s; Quinn could have brought them. Remaining trial charges then listed as causing death, narcotics conspiracy, 924(c), drug-involved premises, kidnapping. Originally charged with others (including Outlaws members and Gerace) in a conspiracy to kill Quinn to keep her off the stand — those counts are not this verdict. — https://www.yahoo.com/news/us/articles/nightmarish-recollection-house-horrors-kicks-223308113.html
  • WIVB (Daniel Telvock, June 11, 2026): prosecutors dismissed two conspiracy charges (retaliation and tampering conspiracy to kill Quinn) for insufficient evidence / witness problems / excluded proof; Wolford granted the request; Gogolack still to be tried on remaining counts including death-result distribution; 911 call at the Wellsville home; prosecutors alleged he first tried to stage the scene as accidental overdose or suicide. This is charging history, not the September verdict. — https://www.wivb.com/news/feds-say-they-lack-evidence-in-alleged-conspiracy-to-silence-witness-in-gerace-case/
  • Court (Dkt. 1089 snippet): suicide argument not barred; hitman-services evidence moot; fentanyl/Xanax conspiracy evidence in. Confirms the trial that reached the jury was already narrower than the original murder-plot indictment.
  • National / TV desks on the verdict: no AP, WKBW, or WIVB verdict story located this pass.

Coverage split note: The fight that matters for /analysis is not partisan. It is USAO “causing death / violence and devastation / 20-to-life” against (1) unsentenced status, (2) death-result statutory theory without intent to kill, (3) dismissed conspiracy-to-kill counts, (4) title intimidation vs body tampering, (5) lumped min/max vs count-specific penalties, (6) an unread not-guilty count in local coverage. Do not invent a culture-war frame. Do not collapse Gogolack’s verdict into Gerace’s 2024 conviction.
