Package note: This is a notice of proposed rulemaking (NPRM) published in the Federal Register on October 14, 2026 (91 FR 65119; DHS Docket No. USCIS-2026-0529). It is a proposal open for comment and changes nothing until a final rule is issued.

Primary sources

  • Federal Register, “Removing Deference to Prior USCIS Determinations of Eligibility” (October 14, 2026): https://www.federalregister.gov/documents/2026/10/14/2026-20941/removing-deference-to-prior-uscis-determinations-of-eligibility

DHS and U.S. Citizenship and Immigration Services propose to remove 8 CFR 214.1(c)(5). That provision “generally provides that USCIS gives deference to a prior approval involving the same facts when adjudicating a request to extend a petition for an alien’s employment or stay.”

Core Tension

Today, when an employer asks to extend a worker’s status on the same facts USCIS already approved, officers generally defer to that earlier decision. DHS says removing the provision would “better align DHS regulations with the statute, which places the burden of proving eligibility… on the petitioner,” strengthen review, and “better protect the interests of U.S. workers.” For employers and workers, the practical effect is that every extension could be re-examined from scratch, with the risk of a denial on facts that were approved before. The NPRM’s abstract does not say how many extensions this would affect.
