Package note: This Analysis covers a Nuclear Regulatory Commission correction published in the Federal Register on October 19, 2026 (91 FR 65941, FR Doc. C1-2026-12067, docket NRC-2023-0212). It amends entry 7.C in Table 2 to paragraph (d) of 10 CFR 171.16, the annual-fee table, in the NRC’s FY 2026 fee rule. That rule was published June 16, 2026, at 91 FR 36470–36509 and took effect August 17, 2026. We compared the correction line by line with the June rule text on federalregister.gov.

Category 7.C covers “other licenses issued under parts 30, 35, 40, and 70” for human use of byproduct, source or special nuclear material. That excludes sealed sources in teletherapy devices. In practice it covers most medical-use materials licenses, priced by number of locations of use. The correction reprints all three tiers of 7.C. It lists $23,300 for 1–5 locations and $33,000 for 6–20 locations. For more than 20 locations, the correction prints the category text and program codes but no dollar amount. The June rule sets that tier at $42,300.

Core Tension

The correction doesn’t change any fee. The $23,300 and $33,000 figures are the same ones the June rule already set for these tiers. The only difference we found between the two texts is in the 1–5 location tier: the correction adds footnote 19 to it, matching the other two tiers. Footnote 19 says licensees paying broad-scope medical fees under 7.B, 7.B.1 or 7.B.2 “are not subject to paying fees under 7.C., 7.C.1, or 7.C.2” for human-use licenses authorized on the same license. That makes the double-billing exemption apply to the smallest tier as well. The notice doesn’t say what the error was. Its page citation is also wrong: it points to “pages 6504 and 6505” of a rule that runs from page 36470 to 36509. In the June rule, entry 7.C appears on pages 36507–36508.

Stated vs. claimed

Claim Assessment Basis
The notice corrects entry 7.C of the FY 2026 annual-fee table Verified Correction text
The correction changes the fees for these medical licenses Not supported $23,300 and $33,000 match the June rule; no new amount for the >20 tier
The fee for more than 20 locations is $42,300 Verified, from the June rule 91 FR 36508; the correction prints no figure for this tier
The visible change is footnote 19 on the 1–5 tier Verified by text comparison The June rule lists footnotes 9 and 17 only for that tier
The correction’s page citation is accurate No The pages cited don’t exist in a rule printed at 36470–36509

Context / what to watch

  • The >20-locations tier: Whether NRC issues a further notice. Leaving the dollar figure out of the corrected text could be read as removing it, but the notice doesn’t say it changes that fee.
  • Billing: Whether FY 2026 invoices for 7.B licensees who also hold small-site 7.C authorizations show the footnote 19 exemption.
  • The eCFR: Whether the codified text of 10 CFR 171.16 changes after this notice.
