Package note: This analysis covers a Justice Department press release of October 15, 2026, announcing a civil complaint against the State of California. A complaint contains allegations only. DHS calls its underlying data match “preliminary” and says the review is “ongoing.” The release does not include California’s response.
Primary sources
- U.S. Department of Justice, “Justice Department Sues State of California over Voter List” (October 15, 2026): https://www.justice.gov/opa/pr/justice-department-sues-state-california-over-voter-list
DOJ, working with DHS, filed a complaint against California “after determining that more than 20,000 people who are likely aliens are registered to vote in California.” The release notes that California mails a ballot to every registered voter and that it is unlawful for noncitizens to vote in federal elections.
Core Tension
DOJ’s officials use strong language. The Attorney General calls it “State-facilitated voter fraud,” and the Acting Deputy AG says California is “knowingly allowing noncitizens to vote.” The release’s own wording is more hedged. The people are “likely aliens” or “likely noncitizens.” DHS calls its analysis “preliminary,” and the complaint alleges these individuals “registered to vote and/or voted.” The release does not say how many, if any, actually cast ballots, does not describe the matching method beyond “multiple data-enrichment and verification methods,” and does not address whether naturalized citizens could be flagged by mistake. The First Assistant U.S. Attorney says California refused requests to remove the names and to set aside suspect ballots.
