Package note: This Analysis covers a Monday, October 19, 2026, press release from the U.S. Attorney’s Office for the District of Colorado (Case No. 1:24-cr-00212-DDD). Every figure below comes from the release. The plea agreement, judgment and restitution order are not attached to it.
Primary sources
- U.S. Attorney’s Office, District of Colorado, “Castle Rock Man Sentenced to 20 Months in Federal Prison, More Than $5 Million in Restitution” (October 19, 2026): https://www.justice.gov/usao-co/pr/castle-rock-man-sentenced-20-months-federal-prison-more-5-million-restitution
Joshua Lybolt, 47, of Castle Rock was sentenced to 20 months in federal prison, $5,346,802.61 in restitution and a $50,000 fine after pleading guilty to one count of wire fraud and one count of money laundering. According to the plea agreement and facts established at sentencing, from April 2020 until around August 2022 he received $4,950,000 in SBA Economic Injury Disaster Loans and $41,667 in Paycheck Protection Program funds. He applied on behalf of Indiana businesses that had gone through bankruptcy, and he falsely certified that they had suffered pandemic losses when they “were not in operation on the dates required to receive relief funds.” U.S. District Judge Daniel D. Domenico imposed the sentence.
Core Tension
The U.S. Attorney says the case will “return significant funds back to the federal government.” The release doesn’t say how much has actually been recovered. It lists what the money bought: a 2022 Porsche Taycan, a 2022 Corvette Stingray convertible, a 2021 Ford Bronco, a 2016 Range Rover, country club and luxury vacation club memberships, and properties in Avon, Basalt and Snowmass Village. It doesn’t say whether any of those assets were seized or forfeited. Restitution of $5,346,802.61 is about $355,000 more than the $4,991,667 he received, and the release doesn’t explain the difference. It also says nothing about the sentencing guideline range, so readers can’t tell whether 20 months for nearly $5 million is a typical sentence or a light one.

- Recovery: whether court records show forfeiture of the vehicles or properties, and how much restitution has been paid.
- Restitution figure: why restitution is about $355,000 more than the loan totals (interest, fees or other losses aren’t explained).
- Docket 1:24-cr-00212-DDD: the judgment and any appeal.
